審前準(zhǔn)備程序初探

    審前準(zhǔn)備是審判程序中的1個相對獨立的訴訟程序階段，有其獨立的價值。該程序階段完結(jié)有其相應(yīng)的訴訟法律后果，對后來的判決結(jié)果有重要影響，審前準(zhǔn)備內(nèi)含著整理案件爭點、固定案件證據(jù)、保障開庭審判、提高庭審效率等功能，但從立法和司法的現(xiàn)狀看來，該程序所存在的缺陷也是不容忽視的，因此應(yīng)對審前準(zhǔn)備程序給予特別關(guān)注，就與之相關(guān)的若干問題展開論述。

ABSTRACT

The civil pre-trial preparation procedure is a relative independent course in a unitary litigation. It has its own value and litigation results. The civil pre-trial preparation produce has the function of regulating disputation, fixing evidence, guaranteeing hearings and enhancing the efficiency of a case. But from the present situation of legislation and jurisdiction, it also has some flaw. So it is very important to pay close attention to the civil pre-trial preparation procedure and make expound of it.
